Fair Work Commission approves termination of AWA’s/ITEA’s.
The FWC approved Telstra’s application to unilaterally terminate all AWA’s/ITEA’s. This will be effective 6th July 2021 and from then, your individual contract will be NOT be valid and the Telstra Enterprise Agreement 2019-2021 will apply to you.
In its decision the full bench stated that their role is quite limited. The Commission must approve termination if it is satisfied that : the individual agreement applies to Telstra and the employee; Telstra made the declaration required; Telstra gave the employee the notice – regardless of whether or not the employee to whom the AWA/ITEA applies agrees to the termination.
In two weeks, (26th April) Telstra will communicate to impacted employees an overview of pay and conditions under the Enterprise Agreement. There are two rates of pay in the Agreement:
Job Family or Workstream. Job Family employees are subject to a pay pool and Workstream employees receive guaranteed yearly pay increases.
The Agreement defines Workstream as follows:
· You terminate an AWA/ITEA which had expired prior to 24/9/10, you did not work in a retail outlet at that date and you elect to be a Workstream Employee; or
· You terminate an AWA/ITEA which applied to you, you perform work which would fall under the Customer Field Workstream or Technical Workstream were you a Workstream Employee, and you elect to be a Workstream Employee.
In all cases, YOU MUST ELECT TO BE WORKSTREAM!
