TECHNICAL AND SERVICES BRANCH WEEKLY BULLETIN 2024

Number 10       17 March 2024

WEB PAGE EXPANSION

We have now integrated the web sites of our former NSW and VIC Branches. We now have what was once dubbed by an international organisation as the largest union web site in the world. (I sound like Trump). But it is true, I am a bit of a data person (as an ex technical officer and serving lawyer) and I share my created resources. You should have access to your current statutory conditions, awards and EBAs with links.
The history is also there. We are working to ensure that current conditions have been converted from PDF to proper links for several more documents.
These bulletins are in the database.

ESTA EBA REPORT

The 4 Unions have been bargaining for a new Enterprise Agreement for over 12 months now and all of the parties want to reach agreement. The are many reasons for the protracted process, some include:

  • The staffing review morphed into bargaining, after 2 years of unsatisfactory progress
  • The Ashton review commissioned by Gov't produced some recommendations that became 000V'S unofficial log of claims. The Govt accepted all of the recommendations. Some of the recommendations included a review of training standards, addressing flexibility and rostering.
  • 000V produced a new classification structure, and new rosters in addition to existing rosters.
  • Some of the above points are reliant on updated or new policies being written because the Enterprise Agreement will refer to them.
Is there an end date to bargaining? No, however if we are unable to reach agreement either party can apply to the FWC for the Commission to resolve a bargaining dispute under s240.
If the parties are still unable to resolve the dispute, the FW Act allows for arbitration under intractable bargaining provisions. If parties can't resolve a dispute after an intractable bargaining declaration is made, the Commission must make an intractable bargaining workplace determination. This means that the FWC may decide on any outstanding matters. We are not at that stage yet.
The last category for discussion is MOU payments and improved leave. All of the documents that have been exchanged are still "in confidence" and not for re-distribution, so we can not release the proposals yet.

    TELSTRA EBA

We will meet with Telstra this week to hear more of Telstra's claims. The union log is being finalized. We thank members who have made comments and suggestions.

    POST NSW JCC

We had our first JCC with the new Manager this week. It appears that we have some common views while others are yet to be tested. One major issue is the role of PTO7 and PTO6 shift staff. A separate meeting has been agreed to deal with this matter and several other shift issues.

    POST EBA

These negotiations are also about to begin. We have issues that need to be resolved including salaries to attract electricians, and apprentices. Your comments welcome.
