On Wed 23 Sep, we lodged an application with the FWC. The Application seeks Orders that a Ballot of members be undertaken seeking approval of a range of bans. See the List of Bans from our PIA Application. The FWC is required to determine the application within 2 days if possible.
TZV raised a number of objections and filed them in the FWC on Thursday, and sought a hearing of the matter. We responded to the objections and did not agree to a hearing.
On Friday 25 Sep, the FWC advised that it would not agree to the hearing sought by TZV and advised that if would determine the matter "on the papers." The parties have been given until 1.00pm Monday to ake any furher submissions. The decision is expected on Monday 28 Sept. We will send TZV Support members a special bulletin on the outcome and orders.

Last Wednesday 23 Sep, we filed an Application in the FWC seeking Orders that a Protected Industrial Action Ballot be conducted by the AEC.
Despite opposition from TZV, the Fair Work Commission granted the Orders we sought.

The Orders declare that the Ballot to approve Industrial Action must close on 10 November. We now await directions from the AEC re the opening off the Ballot and voter lists.
We also await Orders re a compulsory conciliation. The last para of the decision states
[17] Pursuant to s.448A(1), the Commission must conduct a s.448A compulsory conciliation conference in this matter. The Commission will issue an Order requiring the attendance of all bargaining representatives in the proposed enterprise agreement at the conference. It is likely that Directions will also be issued to ensure that the parties attend the conference ready to conduct meaningful negotiations.

Notes re Industrial Action

1. Protected Industrial Action (PIA) is industrial action that can be taken. It is action approved by the FWC and of which 3 working day's notice has been given to TZV by the Union.

2. Only CWU Members can take Protected Industrial Action

3. The action must be limited to that advised by CWU. While there ia a long list of possible bans, only those in the list authorised by CWU can be taken.

4. Inndustrial action must be confined to the times and dates authorisd by CWU.

5. Authorisations will be notified by email. Make sure you have an working email with CWU.
