TZV EBA SUPPORT STRUCTURE DELAYED

Our next meeting has been cancelled as TZV seems to be dysfunctional. TZV advised:

We regret to advise that due to unforeseen delays, we are required to postpone the bargaining meeting scheduled for 1 September where the parties intended to discuss the classification structure claim raised by CWU and independent representatives.
As this claim has the potential to be a significant cost item, TZV has been instructed that it must obtain approval prior to tabling any proposal in negotiations to address this claim in accordance with Wages Policy.
We anticipate at this stage that the meeting to discuss the classification structure will need to be postponed for 4-6 weeks.

TZV EBA SUPPORT RESET NEEDED

Our experience with the Operations EBA was a nightmare delay after delay. We are trying to avoid it again. We wrote to TZV (Morgan Blake) as follows:

We are quite shocked by the development and the tardiness of TZV in dealing with this matter. How can we believe that TZV is genuinely bargaining in accordance with the Fair Work Act? Look at the mess that we observe. 1. The issue of a new structure was agreed in the 2021 Enterprise Agreement. TZV failed to comply with the agreement. Specifically, the Agreement required the following:
Cl 7 ESTA, the Union and the IBR for this Agreement commit to working to co-design a new classification structure based on agreed guiding principles over the life of the Agreement. Terms of reference will be agreed within the first 12 months of the Agreement and will include consideration of the Victorian Public Sector and Emergency Service Agency standards.
    2. The Government agreed to the 2021 EBA and the cost of a new structure. Monies would have been approved and set aside to fund the new structure. These monies should now be available.
    3. We have not seen the proposed structure from TZV. Yet TZV is seeking approval from the Government. It is optimistic to believe that CWU would not be seeking amendments.
    4. TZV breached the 2021 Agreement by failing to comply with the clause relating to renegotiation of the Agreement (despite our efforts to meet). Given the TZV attempt to rebuke CWU over the consideration of clauses, it is obvious that the TZV spokesperson has not read the clause. We set it out for you:
Cl 4 The parties to this Agreement commit to commencing negotiations for an ensuing agreement at least six months prior to the nominal expiry date of this Agreement (30 June 2025).
Given the above, we seek a meeting with yourself and the relevant government officials to discuss the overall position. In particular we wish to discuss the role of the parties, the funding position, the scheme of the restructure and other obstacles to a fair outcome.

TZV RESPONSE

At least TZV responded positively. Their response below. More next week.

TZV will respond to this in full in due course. In the meantime, I can advise that TZV representatives are available to meet with you Tuesday morning (9 Sept) and propose 9.30am. I am not in a position to confirm relevant government representatives attendance at this stage, but will seek their advice on this.
