TZV EBA PAY INCREASE DATE
We still do not have TZV agreement for a date of effect for your pay rise. Your next increase is due on 28 December 2025. The EBA will not be approved by that date and probably not until late February at the earliest assuming we can achieve a proper outcome. The delay is solely the fault of TZV who refused to abide by the EBA clause that negotiations commence 6 months before the expiry date (28 December).
The possibility of industrial action (bans, limitations or stop work) looms large. If members choose that path, we will seek that any outcome applies to union members!
NBN SOD/EOD CASE
The procedures in the clauses below apply only to Telstra employees in limited circumstances. NBN does not have any SOD or EOD provisions in its EBA and we would fight any such provisions. We argue that NBN is unlawfully applying the Telstra provisions by deducting one hour of overtime each day.
We commenced proceedings in the NSW IRC Court to remedy the situation. The case will be heard in April. We are seeking up to 6 years backpay (effectively for one hour of overtime for each day), interest and penalties.
TELSTRA START OF DAY END OF DAY (SOD/EOD)
We are examining the lawfulness of the actions of some managers when deducting 30 minutes travel time at the start and end of day. The provision only operates in very restricted circumstances. This week we will explain the Start of Day provisions. We will later cover living outside the work area, Log in on the night before, and some other circumstances such as project work and work on Travelling Allowance.
TELSTRA SOD APPLICATION EBA CLAUSE
53. FIELD-BASED EMPLOYEES TRAVEL TO WORKSITES
53.1. A field based employee in the Customer Field Workstream may be supplied with a Company vehicle to enable them to do their job. If an employee is supplied with a Company vehicle they will be required to sign a Commuter Use Approval document concerning the vehicle's use, care and maintenance.

To be captured by the clause, all 4 criteria must be met. Clause 53.1:
- Field based AND
- Customer Field Workstream AND
- Company vehicle AND
- Commuter Use Agreement.

54. START OF DAY PROCEDURES - FIRST JOB RECEIVED ON THE DAY
54.1. These procedures apply where an employee receives their first job of the day by logging on to an automated dispatch terminal, where one is provided, or by other means, e.g. telephone/electronic
54.2. Living within their work area:
a) Where an employee lives within their work area they are required to commence to log on no later than 30 minutes before their "on site" start time.
b) After logging on and receiving their first job they will commence travel to their first job. They will travel without unnecessary delay. Where it takes 30 minutes or less for the employee to log on and travel to their first job, they are required to be on site at their start time.
c) The 30 minutes log on and travel time described above does not constitute paid work.

54.1 receives first job of day
- by logging on dispatch terminal or other
54.2 Live within work area
- Commence to Log on
- No later than 30m before onsite start time
- (after that) Commence travel
- To their first job
- Without unnecessary delay
- Where travel is <30min onsite by start time
- 30min "log on" and "travel time" is not paid work
